By accessing or using the Tick platform (including the app, website, and associated services, collectively the "Platform"), you agree to comply with these Terms of Service ("Terms") and all other Tick policies. If you do not agree, you must not use the Platform.

1. Eligibility

1. By law in Australia you must be over 16 years old to create and hold a Tick account.
2. Age verification checks or parental consent may be required for you to establish a Tick user account. This will vary by country and region.
3. Certain features may be restricted for users under 18 and for those that do not have a Tick account.
4. By using Tick, you represent that you meet the eligibility requirements and provide accurate information about your age, identity and country.

2. Account Responsibility

1. Users are responsible for maintaining the security of their accounts.
2. You must provide accurate information and update it as necessary.
3. You are responsible for all activity under your account.

3. Privacy

1. Your use of Tick is subject to our Privacy & Cookies Policy, which explains how we collect, use, and protect your data.
2. Tick is committed to user privacy, transparency, and legal compliance with Australian and international data protection laws.

4. Community Conduct

1. All users, creators, and advertisers must comply with Tick's Community Guidelines, Creator Code of Conduct, Advertiser Content Standards, AI-Generated Content Disclosure Policy, Children & Teen Safety Policy, and Political & Election Content Policy.
2. Prohibited conduct includes harassment, hate speech, illegal activity, copyright infringement, sexual exploitation, and deceptive practices.
3. Tick reserves the right to remove content, restrict features, or suspend accounts for violations.

5. Creator Monetisation & Revenue

1. Creators may be eligible for monetisation through advertising, subscriptions, donations, or sponsored content.
2. Eligibility depends on compliance with all Tick policies and account standing.
3. Revenue is calculated based on engagement, ad demand, location, and platform fees. Tick does not guarantee earnings.
4. Payouts are processed through approved payment providers. Creators are responsible for taxes and legal obligations.
5. Tick may withhold, adjust, or recover earnings in cases of policy violations, fraud, or legal requirements.

6. Intellectual Property

1. You must own or have rights to all content you upload.
2. Tick respects copyright laws and provides a takedown process for rights holders.
3. Repeat infringement may result in permanent account termination.
4. Users may submit counter-notices where allowed by law.

7. Live Streaming Rules

1. Live streams must comply with all Tick policies and not include prohibited content such as violence, sexual content, harassment, or illegal activity.
2. Creators are responsible for the moderation and safety of their streams.
3. Tick may interrupt or terminate live streams, posing an immediate risk.
4. Violations may result in stream termination, suspension, or permanent account removal.

8. AI-Generated Content

1. AI-generated or AI-assisted content must be clearly disclosed.
2. Undisclosed AI use that misleads viewers is prohibited.
3. Creators remain responsible for the legality, accuracy, and ethical use of AI content.
4. Tick may label, remove, or restrict AI content that violates this policy.

9. Children & Teen Safety

1. Tick provides enhanced safety, privacy, and content controls for users under 18.
2. Content, interaction, and advertising targeting minors must comply with age-appropriate standards.
3. Exploitation or inappropriate engagement with minors is strictly prohibited.

10. Political & Election Content

1. Political content must be clearly labeled and comply with election laws.
2. False, misleading, or manipulative political content is prohibited.
3. Political advertising may be restricted, require verification, or be rejected at Tick's discretion.

11. Moderation & Enforcement

1. Tick uses a combination of automated tools, human review, and user reports to enforce policies.
2. Enforcement follows a graduated system:
   • Level 1 – Warning
   • Level 2 – Restrictions (content removal, visibility limits)
   • Level 3 – Suspension (temporary account restrictions)
   • Level 4 – Termination (permanent account removal, possible legal reporting)
3. Users may appeal moderation decisions through official support channels.

12. Prohibited Conduct

You may not:

• Violate laws or Tick policies
• Harass, intimidate, or exploit others
• Upload illegal, harmful, or explicit content targeting minors
• Manipulate engagement or monetisation systems
• Use the Platform to mislead or defraud users

13. Advertising Standards

1. All advertisements must comply with Tick's Advertiser Content Standards.
2. Ads must be legal, accurate, age-appropriate, and clearly distinguishable from user-generated content.
3. Tick reserves the right to remove or restrict any ad that violates these standards.

14. Platform Availability & Liability

1. Tick may modify, suspend, or discontinue features at any time.
2. Tick is not liable for content uploaded by users or creators.
3. You use the Platform at your own risk, except where prohibited by law.

15. Legal Compliance

1. Users, creators, and advertisers are responsible for compliance with applicable laws.
2. Tick may cooperate with authorities and regulators as required.
3. Tick may act to ensure the Platform operates safely and legally.

16. Updates to Terms

Tick may update these Terms to reflect changes in the law, platform features, or best practices. Continued use of Tick constitutes acceptance of updated Terms.

17. Governing Law

These Terms are governed by Australian law. Disputes may be addressed in the courts of competent jurisdiction in Australia unless otherwise required by local law.
